General Terms and Conditions

Status: July 2025 – based on the recommendations of the Austrian Federal Economic Chamber, Hotel Industry Association

1. scope of application
These General Terms and Conditions (GTC) apply to all contracts concluded with Hotel Kristberg, Lech am Arlberg, unless individually deviating agreements have been made in individual cases.

2. Definitions of terms
The definitions correspond to the provisions of the WKO template for the hotel industry. Among other things, an “accommodation provider” is the Hotel Kristberg, a “guest” is the person who makes use of the accommodation.

3. Conclusion of contract – down payment
The accommodation contract is concluded when the hotel accepts the guest’s written or verbal order. The hotel is entitled to demand a deposit of up to 100% of the total booking value. The amount of the deposit and the payment dates shall be agreed upon conclusion of the contract.

4. start and end of accommodation
Unless otherwise agreed, the guest may move into the rented rooms from 16:00 on the day of arrival. The rooms must be vacated by 11:00 a.m. on the day of departure.5. Withdrawal from the accommodation contract – cancellation fee
The cancellation conditions are based on the current information on the Hotel Kristberg website (www.hotel-kristberg.at) as well as the individually agreed booking conditions. In addition, the WKO cancellation conditions apply:

  • Cancellation up to 3 months before arrival: no cancellation fee

  • 3 months to 1 month before arrival: 40 % of the total price

  • 1 month to 1 week before arrival: 70% of the total price

  • In the last week before the arrival date: 90% of the total price

6. Provision of alternative accommodation
The Hotel Kristberg is entitled to provide the guest with adequate alternative accommodation, provided that this is reasonable for the guest, in particular if the deviation is minor and objectively justified.

7. Rights of the guest
By concluding an accommodation contract, the guest acquires the right to the normal use of the rented rooms and the generally accessible facilities of the hotel.

8. Obligations of the guest
The guest is obliged to pay the agreed remuneration punctually and to treat the rented rooms and the facilities of the hotel with care.

9. Rights of the accommodation provider
If the guest is in default of payment, the Hotel Kristberg is entitled to charge interest on arrears and to terminate the accommodation contract for good cause.

10. obligations of the accommodation provider
The hotel is obliged to provide the agreed services to a standard corresponding to the standard and to respond immediately to justified complaints.

11. Liability of the accommodation provider for damage to property brought into the hotel
The hotel shall be liable for property brought into the hotel in accordance with §§ 970 ff ABGB, up to a maximum of the amount provided for by law. Liability for slight negligence is excluded.

12. limitations of liability
The hotel’s liability for slight negligence is excluded to the extent permitted by law. Liability is only assumed for valuables if these have been expressly taken into safekeeping.13. keeping pets
Pets may only be brought into the hotel with the hotel’s prior consent and may incur additional costs.

14. Extension of accommodation
An extension of the stay requires the express consent of the hotel.

15. termination of accommodation
The hotel may terminate the contract without notice for good cause, in particular if the guest violates the house rules.

16. illness or death of the guest in the hotel
In the event of illness or death, the statutory provisions shall apply and the hotel shall act within the scope of its duty of care.

17. place of fulfilment and jurisdiction
The place of fulfilment is Lech am Arlberg. Austrian law shall apply. The competent court at the hotel’s registered office shall have jurisdiction over all disputes.

18. miscellaneous
Supplementary agreements, amendments or additions must be made in writing. Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.</p
